These Terms and Conditions set out the basis on which Rubbish Removal Paddington provides rubbish removal, waste clearance and associated services within its service area. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting the services from Rubbish Removal Paddington.
Services means rubbish removal, waste collection, bulky waste clearance, and any related services provided by Rubbish Removal Paddington.
Waste means any items, materials or substances that the Customer asks Rubbish Removal Paddington to remove, transport and dispose of, subject to applicable waste regulations.
Agreement means the contract between Rubbish Removal Paddington and the Customer for the provision of Services, incorporating these Terms and Conditions.
Rubbish Removal Paddington primarily operates rubbish removal and waste collection services in and around the Paddington area and surrounding neighbourhoods. Acceptance of a booking is subject to location and access. The Company reserves the right to decline bookings outside its normal operating area or where access is unsafe or impracticable.
3.1 Bookings may be made by telephone, email or online booking form, where available. When you make a booking request, you confirm that you are at least 18 years of age and authorised to enter into the Agreement.
3.2 To provide an accurate quote, you may be asked to describe the type and approximate volume or weight of waste to be removed. In some cases, photographs or a site visit may be requested before confirming a price.
3.3 All bookings are subject to availability. The Company will confirm the booking by message, email or verbal confirmation, including the provisional date, time window and pricing basis. The Agreement is formed when the booking is confirmed.
3.4 Any time or date given for attendance is an estimate only. While the Company will use reasonable efforts to attend within the agreed time window, it does not guarantee arrival times and accepts no liability for delays caused by traffic, weather, access, accidents or other events beyond its reasonable control.
4.1 The Company will attend the agreed address to collect waste from the Customer, subject to access and to these Terms and Conditions.
4.2 The standard service covers manual loading of waste into a suitable vehicle by the Company’s operatives, transportation and disposal or recovery at an authorised facility.
4.3 The Customer must ensure that waste is accessible, clearly identified and not mixed with excluded items such as hazardous or prohibited waste. If items are to be collected from inside a property or building, safe and unobstructed access must be provided.
4.4 The Company may, at its discretion, decline to remove any items that are unsafe to handle, inadequately described at the time of booking, or that fall outside the agreed scope of work.
5.1 Rubbish Removal Paddington operates in accordance with applicable UK waste management and environmental regulations. All waste collected will be handled, transported and transferred only to authorised sites in line with legal requirements.
5.2 The Customer is responsible for ensuring that no prohibited, controlled or hazardous waste is presented for collection unless previously declared and accepted in writing. Examples of items that may be prohibited or require special handling include, but are not limited to, asbestos, chemicals, solvents, oils, clinical waste, gas cylinders, tyres, liquids and electrical items requiring specific disposal routes.
5.3 Where the Company reasonably believes that waste presented for removal may be hazardous or non-compliant, it may refuse to collect it, request additional information, or charge an adjusted fee to cover specialist handling and disposal, if this is agreed with the Customer.
5.4 The Customer warrants that the waste presented belongs to them or that they have full authority from the owner to arrange for its removal and disposal. The Customer indemnifies the Company against any claims or costs arising from a breach of this warranty.
6.1 Prices are based on factors including, but not limited to, the type of waste, estimated volume or weight, loading time, access difficulty and distance travelled.
6.2 Any quote given prior to attendance is an estimate based on information supplied by the Customer. If, on arrival, the actual quantity or nature of the waste differs from the information provided, the Company may revise the price accordingly.
6.3 Where a revised price is required, the Customer will be informed before work proceeds. If the Customer does not accept the revised price, the Company may cancel the job. In such cases, a call-out or cancellation fee may apply to cover the Company’s costs.
7.1 Unless otherwise agreed, payment is due on completion of the service and before the collection vehicle departs the site. For business accounts or regular commercial customers, alternative payment terms may be agreed in writing.
7.2 The Company accepts payment by cash, card or other agreed payment methods. The Customer must ensure that sufficient funds are available and that payment details provided are accurate.
7.3 Where an invoice is issued, it must be paid in full by the due date stated. If payment is not received on time, the Company reserves the right to charge interest on overdue amounts and to recover any reasonable costs incurred in pursuing payment.
7.4 Ownership of any waste remains with the Customer until payment is received in full. The Company reserves the right to suspend or withhold services for any Customer with outstanding amounts due.
8.1 The Customer may cancel or reschedule a booking by contacting the Company directly. To avoid charges, you must provide reasonable notice, generally at least one working day before the scheduled collection.
8.2 If a booking is cancelled with insufficient notice, or if the Company attends the site and is unable to carry out the work due to reasons within the Customer’s control, the Company may charge a cancellation or wasted journey fee.
8.3 Reasons within the Customer’s control include, but are not limited to, failure to provide access, non-availability of the Customer or their representative, unsafe working conditions, or waste significantly different in volume or type from that originally described without prior notification.
8.4 The Company may cancel a booking due to circumstances beyond its control, such as severe weather, vehicle breakdown, staff illness or regulatory issues. In such cases, the Company will use reasonable efforts to notify the Customer and rearrange the collection at a mutually convenient time.
9.1 The Customer must ensure that Rubbish Removal Paddington operatives have suitable access to the premises and to the waste to be removed, including any necessary parking arrangements and permissions.
9.2 The Customer must ensure that the collection area is safe, free from hazards and that any pets or children are kept away from the work area while the service is carried out.
9.3 The Customer must provide any necessary information about the property and the waste, including the presence of any fragile items, restricted access points, or other conditions that may affect the safe completion of the work.
9.4 If the service includes removal from inside a property, the Customer is responsible for protecting floors, walls and fixtures, and for removing any items they wish to keep from the immediate work area.
10.1 The Company will exercise reasonable care and skill in providing the Services. However, except as required by law, the Company shall not be liable for any indirect, consequential or economic loss, including loss of profits, business, goodwill or anticipated savings.
10.2 The Company’s total liability for direct loss or damage arising from any single event or series of connected events shall not exceed the total amount paid or payable by the Customer for the relevant Services, unless otherwise required by law.
10.3 The Company will not be liable for damage to driveways, paved areas, access routes or underground services where the Customer has requested the vehicle to enter or park on such areas. It is the Customer’s responsibility to ensure that any surface used can safely withstand the weight and movement of vehicles.
10.4 The Company shall not be liable for any loss or damage resulting from inaccurate information provided by the Customer, including misdescribed waste, incorrect addresses or failure to inform the Company of relevant site conditions.
10.5 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other matter for which liability cannot be excluded or limited under applicable law.
11.1 By presenting items as waste for removal, the Customer confirms that they no longer require those items and that they may be removed and disposed of or recycled at the Company’s discretion.
11.2 The Customer is responsible for ensuring that no items of value, personal belongings or important documents are inadvertently included in the waste. The Company accepts no responsibility for such items once removed.
11.3 If the Company discovers items that appear to be of significant value or importance, it may, but is not obliged to, notify the Customer where reasonably practicable.
12.1 The Company may collect and process personal data relating to the Customer for the purposes of administering bookings, providing services, issuing invoices and complying with its legal obligations.
12.2 The Company will take reasonable steps to keep personal information secure and will not sell or share it with third parties except where necessary to provide the Services, to process payments, to recover debts or where required by law.
13.1 If you are dissatisfied with any aspect of the Services, you should contact the Company as soon as possible, providing full details of the issue.
13.2 The Company will investigate all reasonable complaints and aim to resolve them promptly and fairly. Where appropriate, remedial work, a price adjustment or another form of resolution may be offered at the Company’s discretion.
13.3 If a dispute cannot be resolved directly between the parties, either party may consider seeking advice from an independent body or taking further action through the appropriate legal channels.
14.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice, operational requirements or business needs.
14.2 The version in force at the time of your booking will apply to your Agreement. Customers are encouraged to ask for or review the latest version when arranging a new service.
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms and Conditions or the provision of the Services.
16.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court or other competent authority, the remaining provisions shall remain in full force and effect.
16.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.
16.3 The Customer may not assign or transfer their rights or obligations under the Agreement without the Company’s prior written consent. The Company may assign or subcontract its rights and obligations where necessary to deliver the Services.
16.4 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire Agreement between the parties in relation to the Services and supersede any previous understanding or arrangement.
